Jobseva Terms and Conditions

1. Acceptance of Terms

Welcome to Jobseva ("we", "our", "us", or "the Company"). Jobseva is developed and owned by Meritlife Technologies Pvt Ltd. These Terms and Conditions ("Terms") govern your access to and use of the Jobseva mobile application and any related services (collectively, the "Platform").

By downloading, installing, registering, or using the Platform in any manner, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, do not use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after any modification constitutes your acceptance of the revised Terms.

2. Nature of Service - Intermediary Platform

Important: please read this section carefully.

Jobseva is a neutral, technology-based intermediary platform as defined under the Information Technology Act, 2000. We act solely as a facilitator that enables jobseekers to create profiles and search for job opportunities, and recruiters to post job vacancies and discover candidates.

Jobseva is not an employer, staffing agency, recruitment agency, or employment exchange. We do not participate in, supervise, or control any hiring process, employment contract, or business transaction between users.

Jobseva makes no representation or guarantee that any job posting is genuine, current, legally compliant, or accurately described; any candidate is qualified, available, or suitable for any position; any interaction will result in employment; or the Platform will meet your specific requirements or expectations.

3. Eligibility

You must be at least 18 years of age.
You must be legally capable of entering into binding contracts under applicable Indian law.
You must not be barred from using the Platform under any applicable law.

By using the Platform, you represent and warrant that you meet all eligibility requirements. If you use the Platform on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

4. User Accounts and Registration

You are required to create an account to access most features of the Platform. You agree to provide accurate, current, and complete information during registration; maintain and promptly update account information; keep login credentials confidential; and notify us immediately at support@jobseva.app of any unauthorised account use.

You are solely responsible for all activities that occur under your account. Jobseva shall not be liable for any loss or damage arising from unauthorised access caused by your failure to safeguard credentials. We may suspend or terminate any account at our sole discretion if we believe it has been used in violation of these Terms or applicable law.

5. Terms Specific to Jobseekers

As a jobseeker, you agree to provide truthful, accurate, and up-to-date profile and resume information; not misrepresent qualifications, experience, identity, or other information; not use the Platform for commercial solicitation, spam, or unsolicited communication; and not apply to job postings with fraudulent intent.

Jobseva does not guarantee job placement, interview calls, shortlisting, or any employment outcome. Hiring decisions rest entirely with recruiters. Jobseva is not responsible for fraudulent job offers received through the Platform. You should independently verify any recruiter or job offer before sharing sensitive documents, paying fees, or attending interviews.

6. Terms Specific to Recruiters

As a recruiter, you agree to post only genuine, legal, and accurate job vacancies; avoid roles involving illegal activities, exploitation, or harm; not charge jobseekers any fee in exchange for employment, placement, or referral; not collect personal documents for fraudulent purposes; comply with applicable labour and anti-discrimination laws; and not post misleading, false, or duplicate listings.

Jobseva reserves the right to remove any job posting at its sole discretion without notice or liability. Jobseva is not responsible for the conduct, representations, or actions of any recruiter on the Platform.

7. Prohibited Conduct

Posting or transmitting false, fraudulent, defamatory, obscene, offensive, or unlawful content.
Impersonating any person, company, or entity.
Collecting or harvesting data from the Platform without authorisation.
Using automated bots, scrapers, or crawlers to access the Platform.
Interfering with the security, integrity, or operation of the Platform.
Violating any applicable local, state, national, or international law or regulation.
Soliciting passwords, personal information, or financial details from other users.
Using the Platform for any purpose other than genuine job search or recruitment.

Violation of prohibited conduct may result in immediate account termination and may expose you to civil or criminal liability.

8. Intellectual Property

All content, features, and functionality on the Platform, including text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Jobseva, Meritlife Technologies Pvt Ltd, or their licensors and are protected under applicable Indian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose. You may not copy, reproduce, distribute, create derivative works, reverse-engineer, decompile, disassemble, or remove proprietary notices from any part of the Platform. Any feedback, suggestions, or ideas you provide may be used by Jobseva without obligation to compensate you.

9. Disclaimer and Limitation of Liability

To the fullest extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis. Jobseva makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Jobseva shall not be liable for direct, indirect, incidental, special, consequential, or punitive damages, including loss of employment, income, business opportunity, career prospects, financial loss from reliance on Platform information, harm from interactions with users, fraudulent activity by users, technical failure, downtime, data loss, service interruption, or unauthorised access beyond our reasonable control.

Jobseva's total aggregate liability for any claim shall not exceed INR 1,000 or the amount paid by you to Jobseva in the preceding three months, whichever is lower. You expressly agree that use of the Platform is at your sole risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless Jobseva, Meritlife Technologies Pvt Ltd, and their founders, directors, officers, employees, agents, and affiliates from claims, liabilities, damages, losses, penalties, and expenses arising out of your use of the Platform, violation of these Terms or applicable law, violation of third-party rights, content you submit, or disputes between you and other users. This obligation survives account termination.

11. Third-Party Services and Links

The Platform may contain links to third-party websites, services, or advertisements. Jobseva does not endorse, control, or assume responsibility for third-party content, privacy practices, or terms. Your interactions with third-party services are solely between you and those third parties.

12. Termination

Jobseva may suspend, restrict, or permanently terminate your access to the Platform at any time, without prior notice or liability, for reasons including violation of these Terms, fraudulent or misleading content, harmful conduct, or requests by law enforcement or government authorities. Upon termination, your right to use the Platform ceases immediately. Provisions that should survive termination will remain in effect.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Chennai, India.

Before initiating legal proceedings, you agree to first attempt to resolve the dispute by contacting Jobseva at support@jobseva.app and providing a written description of the issue. Jobseva will endeavour to resolve the matter within 30 days.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jobseva regarding the Platform and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 No Waiver

Failure by Jobseva to enforce any provision of these Terms shall not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without Jobseva's prior written consent. Jobseva may freely assign its rights and obligations.

14.5 Force Majeure

Jobseva shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, government actions, internet outages, or technical failures.
